2005-Dec-16: Sir Paul and Ringo Sue EMI

Sir Paul, Ringo, and relatives of John and George are suing EMI in an effort to recover more than $53 million in unpaid royalties from the record company. According to Neil Aspinall of Apple Corps LTD:

"We have tried to reach a settlement through good faith negotiations and regret that our efforts have been in vain. Despite very clear provisions in our contracts, EMI persists in ignoring their obligations and duty to account fairly and with transparency. Apple and The Beatles are, once again, left with no choice but to sue EMI."

This is the second time Apple Records and EMI have been engaged in a court battle over royalties. An earlier lawsuit was resolved out of court in 1989. EMI owns the copyright to the Beatles recordings in perpetuity. An audit of the company revealed that EMI has not been fulfilling the terms of its contract with them. The current lawsuits were filed on Thursday against EMI in London and against its Capitol Records subsidiary in New York. A spokeswoman for EMI told reporters:

"Artists do sometimes request an audit of their record label's accounts, that's not unusual, but sometimes there are differences of opinion, especially when the contracts are large and complex, when you can get issues of contractual interpretation. Ninety-nine out of 100 audit problems are resolved by amicable settlements for a small fraction of the claim."
