Today the Beatles' multimedia corporation,Apple Corps, lost its British High Court battle with Apple Computer. This means that Apple Computer may continue to use the apple logo and name on its iTunes music store web site Apple Corps had accused Apple Computer of breaching an agreement by allowing iPod users to download and save thousands of song on the Internet. Apple Corps claims that according to the 1991 agreement, they own the exclusive right to use "apple" trademark for the music business. Judge Edward Mann ruled that the logo was used in association with the Apple Computer store, not the music, and thus was not a breach of the agreement.
Regarding the ruling, Apple Corps manager Neil Aspinall reacted to the ruling saying:
Apple Corps uses a shiny green apple as its logo, while Apple Computer uses a gray cartoon-like apple with a neat bite taken out. The verdict could cost Apple Corps more than $ 5.6 million dollars in legal costs. Apple Corps was started by the Beatles in 1968 and is still owned by Paul McCartney, Ringo Starr, Yoko Ono, and the estate of George Harrison."With great respect to the trial judge, we consider he has reached the wrong conclusion. We felt that during the course of the trial we clearly demonstrated just how extensively Apple Computer had broken the agreement. We will accordingly be filing an appeal."
